Fox News interrupted its live programming with urgent breaking news regarding President Donald Trump’s global tariff policies, delivering what many are calling the biggest legal setback of his second term.
Anchor Bret Baier informed viewers that a federal appeals court has ruled the majority of Trump’s tariffs to be unlawful, saying the president overstepped his authority when imposing them. The ruling comes just days after Trump announced a 25% tariff on more than 400 categories of UK imports containing steel and aluminum, followed by a 50% tariff on Indian goods in response to New Delhi’s continued purchase of Russian oil.
Fox News correspondent David Spunt explained that although the court struck down the tariffs, they will remain in effect until October 14, when the mandate officially takes effect. He noted that the 127-page decision declared most of the tariffs unconstitutional because they were not authorized under the International Emergency Economic Powers Act (IEEPA). The court clarified that while the law grants the president broad powers during a national emergency, it does not include the authority to impose tariffs or taxes.
According to Spunt, the Biden administration now has the option to appeal directly to the U.S. Supreme Court, and many expect that move to happen quickly. In the meantime, the current tariffs will continue for at least the next six weeks.
Reacting on Truth Social, Trump blasted the ruling, calling the appeals court “highly partisan.” He warned that removing the tariffs would be a “total disaster for the country,” claiming it would weaken the U.S. financially and “literally destroy America” if the decision is allowed to stand.
This ruling marks a critical turning point in the ongoing debate over Trump’s aggressive trade measures, raising questions about presidential powers, global trade stability, and the future of U.S. economic policy.
